The goal of our crisis support services (Services) is to help empower you to stay healthy and safe in a crisis. When you use our Services, that does not create or imply a therapist-client relationship, a doctor-patient relationship, or an attorney-client relationship. Our Services are not, and they are not intended to be, a substitute for mental health treatment, psychiatric care, therapy, health care, medical advice, diagnosis, or treatment of any kind. If you think that you are experiencing a medical emergency, you should immediately contact your doctor or call 101. And, if you are experiencing a clinical or long-term issue, you should consult with a medical professional.
By using or accessing our website or our Services, regardless of how you contact us, you agree to these Terms of Service (“Terms”). Any changes to these Terms will be effective immediately upon our posting them to our website at www.atthii.com. If you continue to use the Services after we post changes to these Terms, this will mean that you accept the revised Terms.
You agree to use our Services only for legal and legitimate purposes. You agree not to use our Services (a) to violate law, (b) to exploit or harm others; (c) to threaten, harass, “spam,” or abuse our Services and staff, (d) to impersonate someone else, (e) to do anything that impairs anyone’s use of the Services, or which we determine may harm our Services, our staff or other users, or expose them to liability, (f) to violate our intellectual property rights, such as attempting to copy, reverse engineer, or make derivative works of our Services without our express written permission, or (g) to otherwise try to interfere with the Services. Our Terms and our Services are governed solely by and will be interpreted according to, the laws of the State of California without giving effect to conflicts of law rules. We and you both consent to the exclusive jurisdiction of the state and federal courts located in the county of Los Angeles, California for any disputes arising out of or concerning our Terms or our Services. If a court finds any provision of our Terms invalid or unenforceable, that provision will be enforced to the maximum extent possible, and the remaining terms will remain in full force and effect. These Terms are the entire agreement between you and us, superseding any other written or oral agreements or understandings.
You assume all risks for the use of our Services. Neither us, nor any of our employees, volunteers, agents, service providers, contractors or partners will have any liability in connection with acts or omissions by you or a third party during or after your use of the Services, or our Services being unavailable to you.
You agree to indemnify us and hold us harmless for damages (including indirect, consequential and other damages) arising out of (a) your use of our Services, (b) your breach of our Terms, (c) your violation of the law, (d) any third-party claims that you are violating our Terms.
We cannot promise that our Services will always meet your needs or expectations, or that they will always function as we intend them to. In other words, we provide our Services on an “as is” and “as available” basis. We expressly disclaim all warranties of any kind, whether express, implied or statutory, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Without limiting the above, we do not make any warranty that we will (a) meet your requirements, needs or expectations, or (b) be uninterrupted, timely, secure or error-free. These disclaimers of liability apply to all damages or injuries, including those caused by any failure of performance, error, omission, interruption, deletion, defect or delay in operation or transmission, whether for breach of contract, negligence or any other cause of action or claim.
